The 2005 Cumulative Supplement includes the following updates:

Chapter 4A on new white-collar exemption rules has been revised and expanded.

The Second Circuit rejected a DOL regulation that exempts from minimum wage and overtime requirements healthcare attendants who work for a third party employer providing companionship services.

The Second Circuit reversed the district court’s entry of summary judgment for a garment manufacturer, and in so doing established a liberalized rule for joint employer analysis.

The Fourth Circuit, in a case of first impression in that circuit, affirmed the district court ruling that a service advisor at an automobile dealership was exempt under the automobile dealership exemption (29 U.S.C. Section 213(b)(10).

The Ninth Circuit affirmed summary judgment in favor of the Secretary of Labor that two home health care companies were a single enterprise by virtue of being a unified operation and under common control.

The First Circuit reaffirmed its earlier ruling that time spent walking between the station at which the plaintiffs donned required gear and the station at which they clocked in was noncompensable, rejecting the Secretary of Labor’s arguments that such time should be compensable.
